Court of Protection Deputyship

The Court of Protection makes financial or welfare decisions on behalf of people who do not have the mental capacity to make those decisions for themselves.

There are many reasons why a person in your life may no longer be able to manage their own financial affairs or make inform decisions about their personal welfare. Physical and mental illnesses are just a few common factors.

In cases like this, it is often necessary to appoint a Deputy to be responsible for the vulnerable person’s decisions about issues like property and finance and healthcare. Deputyship is usually given to a close family member or a friend or to a professional and must be applied for through the Court of Protection.

The process of applying for a Deputyship can be stressful. We also understand that you will need support as you go forward in your role as Deputy.

We can help you apply for a Deputyship. We can also act as Deputy in complex cases, where there is no other suitable Deputy and cases where a Deputy has given up or would like to give up their duties.

There are two forms of Court of Protection Deputyship:

  • Deputyship for Property and Affairs
  • Deputyship for Personal Welfare
